Action Figure Essentials is an independent UK online retailer specialising in action figures, collectibles, display stands, storage products, replacement parts and related accessories.
SECTION 2 — ABOUT THESE TERMS
These Terms apply when you use our website or purchase products from us. Please read them before placing an order.
By placing an order, you confirm that you have read and accepted these Terms together with our Return and Refund Policy, Privacy Policy, Shipping Information and Legal Notice.
Nothing in these Terms limits or excludes any statutory rights available to consumers under applicable law.
We may update these Terms occasionally. The version applying to your purchase will be the version published when your order was placed.
SECTION 3 — ELIGIBILITY TO PURCHASE
You must be at least 18 years old and legally capable of entering into a contract to place an order through our website.
Many products sold by Action Figure Essentials are adult collectibles rather than children’s toys. Products may contain small parts, sharp points, fragile components, magnets, batteries or other features unsuitable for children.
Please review the product description, manufacturer’s age guidance and safety information before purchasing or using any product.
SECTION 4 — PRODUCT INFORMATION
We take reasonable care to ensure that product descriptions, photographs, specifications, prices and availability information are accurate.
However:
• Colours may appear differently depending on your screen or device.
• Manufacturers may change packaging or specifications without notice.
• Measurements may be approximate.
• Stock photographs may be used where stated or appropriate.
• Minor variations can occur between individual mass-produced items.
If we discover a material error affecting your order, we will contact you and offer you the choice of proceeding with the corrected information or cancelling for a full refund.
SECTION 5 — COLLECTIBLES AND PACKAGING CONDITION
Action figures and collectibles are mass-produced products. Minor variations in paint application, tailoring, assembly, joint tension, alignment or finish can occur during manufacturing.
Product packaging may also display minor factory, storage or transit characteristics. Unless a product is specifically described as mint, graded or guaranteed to meet a particular packaging standard, we do not guarantee grading-level packaging condition.
We package orders carefully, but outer packaging and manufacturer boxes are primarily designed to protect the product contained inside.
Nothing in this section affects your legal rights if a product is faulty, damaged, unsafe or materially different from its description.
SECTION 6 — PRODUCT COMPATIBILITY
Compatibility information is provided in good faith using the information available to us.
Figures, bodies, clothing, head sculpts, display stands, replacement parts and accessories can vary between manufacturers, product lines and production runs. A stated scale alone does not guarantee compatibility.
Please review all measurements, peg sizes, photographs and compatibility information before ordering. If you are uncertain, contact us before purchasing and tell us the exact figure or product with which the item will be used.
Compatibility cannot be guaranteed unless we expressly confirm it for the specific combination concerned.
SECTION 7 — PRICES AND TAXES
Prices are displayed in the currency selected on the website and include UK VAT where applicable.
Delivery charges and any available discounts are shown before checkout is completed.
Prices and promotions may change without notice, but changes will not affect an order that we have already accepted.
For international orders, local import VAT, customs duties, clearance charges or handling fees may be payable by the recipient. Unless expressly stated otherwise during checkout, these charges are not included in the price paid to us.
SECTION 8 — PLACING AN ORDER
When you submit an order, you are offering to purchase the products in your basket under these Terms.
An order confirmation email acknowledges that we have received your order. It does not necessarily mean that the order has been accepted.
A contract is formed when we confirm dispatch of your order, unless we have expressly confirmed acceptance earlier.
We may decline or cancel an order before dispatch for legitimate reasons, including:
• The product is unavailable.
• Payment has not been authorised.
• The price or product information contains a material error.
• We cannot deliver to the supplied address.
• Purchasing restrictions have been exceeded.
• We reasonably suspect fraud, misuse or unlawful activity.
If payment has already been taken for an order we cannot accept, the amount paid will be refunded.
SECTION 9 — PAYMENT
Payment must be made using one of the methods offered at checkout.
You confirm that you are authorised to use the selected payment method and that the billing and delivery information supplied is complete and accurate.
Payments are processed through Shopify and the applicable payment provider. We do not directly store complete payment-card details.
SECTION 10 — DELIVERY
Available delivery services, estimated times and charges are shown at checkout or explained in our Shipping Information.
Delivery estimates are not guaranteed delivery dates unless we expressly state otherwise.
We will take reasonable steps to dispatch and deliver your order within the stated period. If an event outside our reasonable control causes a significant delay, we will contact you where possible and explain the available options.
Please provide a complete and accurate delivery address. We are not responsible for delays or failed delivery caused by incorrect or incomplete information supplied by the customer.
Your statutory rights concerning late or failed delivery are not affected.
SECTION 11 — INTERNATIONAL ORDERS
Customers are responsible for checking whether products can lawfully be imported into and used within their destination country.
International orders may be inspected or delayed by customs authorities. The recipient is responsible for applicable import taxes, customs duties and carrier handling charges unless checkout expressly states that these have been collected in advance.
If an international parcel is returned because charges were refused, delivery was not accepted or an incorrect address was supplied, reasonable costs incurred may be deducted from any refund where legally permitted.
SECTION 12 — CANCELLING AN ORDER BEFORE DISPATCH
If you wish to cancel an order before it has been dispatched, contact us as soon as possible at sales@actionfigureessentials.co.uk.
We will try to stop the order, but we cannot guarantee cancellation once processing or dispatch has begun.
If the order has already been dispatched, it will normally need to be handled as a return.
SECTION 13 — ONLINE CANCELLATION AND RETURNS
UK consumers normally have the right to cancel most online purchases without giving a reason.
You must tell us that you wish to cancel within 14 days beginning the day after you, or a person nominated by you, receives the goods.
After notifying us, you must return the goods within a further 14 days.
Unless the goods are faulty, damaged, incorrectly supplied or otherwise not in conformity with the contract, you are normally responsible for the direct cost of returning them.
You may inspect goods as you would reasonably be permitted to inspect them in a shop. We may make a deduction from the refund where handling beyond what is reasonably necessary has reduced the value of the goods.
Where cancellation rights apply, eligible refunds will include the product price and the cost of our least expensive standard delivery option. Additional amounts paid for an enhanced or expedited delivery service are not necessarily refundable.
Refunds will normally be made using the original payment method. We may wait until we have received the returned goods or you provide evidence that they have been sent back.

SECTION 14 — FAULTY, DAMAGED OR INCORRECT PRODUCTS
Please contact us promptly if a product arrives damaged, is faulty, is unsafe, is materially different from its description or is not the product ordered.
We may request photographs and ask you to retain the product, packaging and delivery materials while the issue is investigated. These requests help us assess the problem and, where appropriate, raise a claim with the delivery carrier or supplier.
Opening a product does not automatically remove your statutory rights where opening it was reasonably necessary to discover a fault or other problem.
Depending on the circumstances and applicable law, an appropriate remedy may include a refund, repair, replacement or price reduction.
Nothing in our policies limits your rights under the Consumer Rights Act 2015 or other applicable consumer legislation.
SECTION 15 — TITLE AND RISK
Ownership of products passes to you once we have received full payment.
Responsibility for accidental loss or damage normally passes to you when the order is delivered to you or to a person you have nominated to receive it.
If you independently arrange for a carrier that we did not offer, responsibility may pass to you when the goods are handed to that carrier, as provided by applicable law.
SECTION 16 — WEBSITE AVAILABILITY
We aim to keep the website accurate, secure and available, but we cannot guarantee uninterrupted or error-free access.
We may update, suspend or withdraw parts of the website where reasonably necessary for maintenance, security, operational or legal reasons.
SECTION 17 — ACCEPTABLE USE
You must not:
• Use the website for unlawful or fraudulent purposes.
• Interfere with the website’s operation or security.
• Introduce viruses, malicious code or harmful material.
• Attempt to obtain unauthorised access to systems or customer accounts.
• Place fraudulent orders or submit deliberately false claims.

• Misuse our intellectual property or the intellectual property of others.
We may restrict access, cancel orders or report activity where we reasonably believe fraud, abuse or unlawful conduct has occurred.

Unless stated otherwise, the text, original photography, graphics, branding, logos, product descriptions and website content created by Action Figure Essentials belong to us or are used with permission.
You may view and use the website for personal, non-commercial shopping purposes. You must not reproduce, distribute, modify or commercially exploit our original content without written permission.
Manufacturer names, character names, trademarks and third-party logos remain the property of their respective owners. Their use is for identification and product-description purposes and does not imply affiliation or endorsement unless expressly stated.
SECTION 19 — THIRD-PARTY SERVICES AND LINKS
Our website may contain links to third-party websites and may use services provided by Shopify, payment providers, delivery companies and other suppliers.
Third-party websites are governed by their own terms and privacy policies. We are not responsible for content or services provided independently by third parties, except where the law provides otherwise.

We process personal information in accordance with our Privacy Policy and applicable data-protection law.
By placing an order, you understand that relevant information may be shared with payment processors, delivery providers and other service providers where necessary to process and fulfil the order, prevent fraud or comply with legal obligations.

We do not exclude or limit liability where doing so would be unlawful. This includes liability for:

If you are purchasing as a consumer, we are responsible for losses that are a foreseeable consequence of our breach of these Terms or failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
Products sold through this website are supplied for private use unless otherwise agreed. We are not responsible for business losses, loss of profit, loss of revenue or loss of business opportunity resulting from consumer use of a product.
Nothing in this section affects your statutory consumer rights.
SECTION 22 — EVENTS OUTSIDE OUR CONTROL
We are not responsible for a failure or delay caused by circumstances genuinely outside our reasonable control, provided that we take reasonable steps to minimise the effect and comply with our legal obligations.
Such events may include severe weather, transport disruption, industrial action, customs delays, network failures, natural disasters or government restrictions.
If an event materially affects your order, we will contact you where reasonably possible and explain the available options.
SECTION 23 — SEVERABILITY
If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.

These Terms and purchases made through this website are governed by the laws of England and Wales.
If you live elsewhere in the United Kingdom or in another country, you may also benefit from mandatory consumer protections applicable where you live.
Nothing in these Terms removes any right you may have to bring proceedings in a court available to you under applicable consumer law.
